Who's in scope
Does the EAA apply to you?
It covers B2C digital products and services offered to consumers in the EU. If any of these describe you, you are almost certainly in scope.
- You sell to consumers online — e-commerce, subscriptions, bookings or ticketing.
- You operate in banking, payments, or consumer insurance.
- You work in transport, telecom, e-books, streaming or other digital media.
- You serve EU consumers — no matter where your company is registered.
Only micro-enterprises providing services are exempt: fewer than 10 staff AND under €2M annual turnover. Everyone above that threshold is expected to comply.
What's at stake
Non-compliance is already being enforced.
This is no longer a future deadline. Regulators across the EU are actively supervising the market, and the first penalties and lawsuits have landed.
- France
Accessibility lawsuits filed against non-compliant services since November 2025.
- Netherlands · ACM
Active market surveillance and enforcement by the ACM regulator.
- Sweden
Formal market surveillance running since October 2025.
- Germany · BFSG
Fines of up to €100,000 per violation under the national accessibility law (BFSG).
- EU-wide
Risk of forced remediation, removal from market, and public reputational damage.

An overlay widget will not make you compliant.
Accessibility overlays — the “one line of JavaScript” that promises instant compliance — do not satisfy the EAA, and regulators and courts have rejected them. accessiBe, the best-known overlay vendor, was fined $1M by the US FTC for deceptive accessibility claims.
The EAA requires accessibility in the code itself: semantic HTML, keyboard operability, proper contrast and focus, correct ARIA — measured against WCAG 2.1 AA through the harmonised standard EN 301 549. A script layered on top cannot deliver that.
A widget can actually raise your risk: it advertises a compliance claim you can't back up, which is exactly what enforcement action targets. Real fixes belong in the codebase — which is what we do.

FAQ
Straight answers.
Who exactly does the EAA apply to?
B2C digital products and services offered to consumers in the EU — e-commerce, banking, transport, telecom, e-books and more. Micro-enterprises providing services (under 10 staff and under €2M turnover) are exempt; nearly everyone else is in scope.
What's the compliance standard?
WCAG 2.1 level AA, applied through the EU's harmonised standard EN 301 549. That's the concrete, testable benchmark an audit measures against.
We already have an accessibility widget — are we covered?
No. Overlay widgets do not achieve compliance and have been rejected by regulators; accessiBe was fined $1M by the US FTC over its claims. Compliance has to be in the code. If you have a widget, we'll tell you honestly where you actually stand.
How long does it take?
The audit is delivered in 5 working days. Remediation time depends on the size of the site and how many issues are found — the audit report makes that predictable.
What do we get from the audit?
A full WCAG 2.1 AA report: a prioritised list of every violation, annotated screenshots of each issue, and a concrete remediation plan you could hand to any developer.
What are the penalties for non-compliance?
They're set nationally — for example up to €100,000 per violation in Germany under the BFSG — alongside lawsuits and active market surveillance already underway in France, the Netherlands, Sweden and beyond.
Do we need a re-audit later?
Yes, if the site keeps changing. New features and code can reintroduce issues, so release monitoring plus an annual re-audit keep you compliant over time.
Where does the EAA apply?
Across all 27 EU member states. It's an EU directive (2019/882) transposed into national law in each country, so a single standard applies EU-wide.
